California SB 292 Offers More Protection from Harassment and Opportunities for Justice

What is California State Bill 292?

Prior to the passage of California State Bill 292, sexual desire had to be included in definitions of workplace sexual harassment. Attorneys had to show that sexual desire on the part of the harasser was their motivation, but SB 292 amends Section 12940 of the California Government Code which established this definition that was reaffirmed by appellate courts over the last several years. Now if a victim of harassment was targeted based upon their gender, sexual harassment may be alleged. If a strong argument can be made that such harassment occurred, the victim may be entitled to significant compensation.
