After 17 Years, San Jose Man Freed After Wrongful Conviction

Court Overturns Wrongful Conviction of San Jose Man

In 2004, a local man received a life sentence after being found guilty of committing a shooting in San Jose. On May 17, 2019, more than 16 years later, the man was freed from prison after the judge in his case overturned the conviction. 

The original crime involved a drive-by shooting in San Jose in April of 2002 that left another person paralyzed. Over the course of the trial, the victim identified the man out of a photo lineup as the shooter, while multiple witnesses reported seeing him at the scene. A jury found him guilty of attempted murder, and he spent the time since in the Pleasant Valley State Prison. 

Both the convicted man and his family members continued to protest his innocence. When California Senate Bill 1134 was passed in 2016, it allowed them to eventually reopen the case. The bill allows defendants to obtain a new trial when additional evidence is uncovered. In this case, the new evidence was a previous statement to police made by the shooting victim. In that statement, he admitted not having a clear view of the shooter’s face and that he was unsure of whether the person he identified was actually the one who pulled the trigger.
