Alcohol Plays Role in Car Accident Killing Two Teens

Posted on in Personal Injury

fatal DUI accident, San Jose car accident attorneys, drinking and driving, felony DUI, fatal car accidentsDrinking alcohol and getting behind the wheel is a dangerous combination and can lead to car accidents and injuries that can be severe and life threatening. When fatal accidents do occur, it is particularly tragic and tough on surviving family members, especially knowing that it could have easily been prevented. A recent fatal DUI accident involving a female driver in San Jose highlights the potential dangers of drinking and driving and the devastating consequences that can occur as a result.

San Jose Drunk Driver Responsible For Fatal DUI Accident

In late March 2018, the Mercury News reported on a fatal DUI-related accident that involved a San Jose woman and three teenagers on a spring break trip. The crash occurred on I-5 near Los Banos, which killed two of the teens involved, and left the third with serious injuries.

A San Jose woman has been charged with felony DUI for her role in causing the accident. She was driving in the northbound lanes of the interstate when her car veered across a dirt median, colliding with a Nissan headed south in the opposing lane. The car carried three Nevada Union High School students, part of a larger caravan headed towards Pismo Beach for spring break. The force of the impact left two of the teens dead, while the third suffered major injuries, including a broken hip.

The accident closed off I-5 for hours afterwards while emergency workers and investigators attended to the scene. The California Highway Patrol reported that alcohol was a factor in the crash and arrested the 21-year-old San Jose driver for felony driving under the influence and vehicular manslaughter while intoxicated.

Alcohol a Leading Factor in Fatal Car Accidents

According to the Centers for Disease Control and Prevention (CDC), alcohol use on the part of drivers is a leading contributing factor in roughly one out of every three fatal car accidents which occur in the United States each year. In California, DUI-related car accidents have claimed the lives of more than 10,000 people over the past 10 years. For surviving family members of the victims in these crashes, there is nothing that can erase their pain at losing a loved one, but taking actions to hold the responsible party accountable can help bring about a sense of justice.

Drunk drivers face severe penalties from the courts when DUI-related fatal crashes occur. The California Code of Civil Procedure also allows these drivers to be held legally liable by the family of the victim through a wrongful death lawsuit.
