Proposed Bike Law Would Allow Cyclists to Roll Through Some Stop Signs

California accident attorney, California personal injury lawyerTwo lawmakers have put forward a bill that would essentially allow bicyclists to treat stop signs as yield signs. If passed, bicyclists would be able to go through stop signs at clear intersections with nothing more than a rolling stop. The new law would not apply to traffic signals. Proponents of the bill argue that this law would make the roads safer for bicyclists, who are at a great risk of injury in the event of a collision with a motor vehicle.

How Would the Law Make the Roads Safer?

The lawmakers who introduce this bill claim that by reducing the amount of time cyclists are at an intersection, the risk of an accident between bicycles and cars is reduced. Requiring cyclists to come to a full stop substantially increases the amount of time spent at each intersection.

Proponents point to studies that back up their safety claims as well as the fact that Idaho has had a similar law in place since 1982. After Idaho enacted its law, the state saw a decline in bicycle-related injuries. Idaho is the only other state to have such a law.

Detractors of the bill argue that it would create more accidents, especially when the law was first implemented and drivers and bikers were still figuring out how the law would operate. Also, detractors do not like that the law creates one set of rules for cars and one for bikes.

California Bikers Are at Risk

It is important to seek ways to protect bicyclists as California has the sixth highest fatality rates per capita in the United States. Florida has the highest.

Each year more than 100 bicyclists are killed and thousands more are injured in California. In many of the accidents, bike riders are not the at-fault party. Cars often cause these accidents because drivers are not paying attention to road and bicycles can be hard to see.
