Injured by Uber? Here’s What You Need to Know

These new companies posed an issue, however, for what party and what insurer would be responsible for injuries in the event of a car accident. These insurance coverage issues have been addressed by California. However, this area of law is new and could see changes as new problems arise.

Types of Accidents Involving Uber

There are several ways an accident can happen with an Uber driver where the Uber driver is at fault:

  • You could be the passenger in an Uber;
  • You could be hit by an Uber driver while the Uber driver had a passenger; or
  • You could be hit by an Uber driver while he or she did not have a passenger in the car.

Keep in mind that you could be a pedestrian, bicyclist, or riding in another car and be struck by an Uber driver.

Insurance Coverage in Uber Accidents

California saw that rideshare companies were popular, and there was a need for increased insurance coverage requirements. California passed California Vehicle Code Section 5430, which requires that rideshare companies carry $1 million in insurance for death, personal injury, and property damage.

This insurance will only cover accidents that occur from the time a driver accepts a ride request on the rideshare app until the driver completes the transaction or until the ride is complete (whichever is later).

Thus, if you are in a car accident during this time, the $1 million insurance policy will be in force. If the Uber driver has just completed a trip and hits a pedestrian, if the accident is the Uber driver’s fault, it is likely a lower insurance policy will apply. This policy could be the Uber driver’s personal insurance policy.

The advantage of having a larger insurance policy in force at the time of the accident is that the victims are more likely to be fully compensated for their injuries.
