Lawsuit Claims Time Warner Violated Labor Laws

At least 10 current and former employees of Time Warner have claimed in a wage and hour lawsuit, that the company violated labor laws and engaged in wage theft.

The lawsuit has been filed against Time Warner Cable's Colorado Springs call center. The lawsuit has been filed on behalf of more than 400 workers by 10 plaintiffs, all of who live in Colorado. Each of these plaintiffs worked as an hourly employee at the call center, and were eligible for overtime benefits.

According to the lawsuit, Time Warner Cable made the plaintiffs work more than 40 hours per week, without paying them the overtime compensation that they were entitled to. The employees are suing Time Warner Cable for the wages that they are owed, as well as monetary damages for the unpaid overtime that they were eligible for. They are also seeking pre-judgment and post-judgment interest on these unpaid wages, attorney fees, legal costs and other damages.

The lawsuit says that the workers were made to arrive at work between 20 and 30 minutes earlier than their scheduled start time to make sure that the computers were booted up, and computer programs were logged into much before the actual work time began. Needless to say, the workers were not paid for this extra time that they put in.

Further, the plaintiffs claim that they were made to work through their 15-minute unpaid rest breaks at least 2 to 3 times per week. This was because they were busy handling continuous incoming calls, and were also made to fill out numerous forms as part of their duties, causing them to miss their rest breaks on many occasions.
