New Developments In High Profile Personal Injury Litigation

Posted on in Personal Injury

On Monday, April 4, a federal judge absolved Porsche of any wrongdoing in the 2013 Santa Clarita, California, crash that took the lives of actor Paul Walker and driver Roger Rodas.

Federal Judge Rules on Claim

Rodas' widow filed a federal lawsuit, claiming that the Porsche Carrera GT lacked important safety features, including a roll cage. However, in his decision, U.S. District Court Judge Philip Gutierrez wrote that the "plaintiff has provided no competent evidence that Rodas' death occurred as a result of any wrongdoing on the part of the defendant."

Following the fatal wreck, investigators with the California Highway Patrol and the Los Angeles County Sheriff's Department cited excessive speed as the cause of the crash. Investigators estimated that the vehicle was traveling as fast as 94 mph when it crashed.

Other Litigation Still Pending

This federal district court ruling does not impact two other cases filed in Los Angeles Superior Court by Paul Walker's father and daughter. Those suits assert that the Porsche's speed was between 63 and 71 mph at the time of the accident, according to a report by the Detroit News.

Although every crash with injuries or fatalities is unique, this crash illustrates some of the complexities that may arise in traffic accident litigation. In some cases, survivors of victims may assert that a negligent design caused or contributed to a fatality.

If you or a family member is a victim in a crash where negligence may have been a factor, it is possible to review the details from a legal perspective with a personal injury.
