Police Arrest Driver for Fatal Hit-and-Run in San Jose

San Jose Resident Charged with Hit-and-Run 

A hit-and-run accident in San Jose recently left a bicyclist with fatal injuries and the driver facing criminal charges. The crash occurred during the afternoon hours at the intersection of Curtner Avenue and Briarwood Drive.

Police reports indicate that a 62-year-old bicyclist was struck in a collision involving a white Ford. Rather than stopping or attempting to help the victim, the driver of the vehicle fled the scene. The bicyclist was taken to a nearby hospital but eventually died as a result of his injuries. 

Armed with a description of the vehicle, police were able to apprehend the suspect shortly after the crash occurred. The man involved, a 35-year-old San Jose resident, was immediately arrested. The San Jose Police Department states that he faces charges of hit-and-run and vehicular manslaughter.  

Penalties for Hit-and-Run In San Jose

Statistics from the California Office of Traffic Safety (OTS) indicate that close to 800 hit-and-run car accidents are reported annually in Santa Clara County. Unfortunately, the number of hit-and-runs involving serious and potentially fatal injuries has steadily climbed each year. There are numerous factors that can cause drivers to leave an accident scene. These include: 

  • Shock and panic at being involved in a crash;

  • Driving without a valid license, registration, or insurance;

  • Driving under the influence of alcohol or drugs;

  • Being wanted by the law for other criminal matters; and

  • Problems with immigration status.

Under California Vehicle Code Section 20002, you can face misdemeanor criminal charges for a hit-and-run for leaving the scene of an accident and for failing to identify yourself to others in crashes where there are property damages. These charges involve fines up to $1,000 and up to one year in jail. 

If you are a hit-and-run driver in a crash which results in injuries or the death of another, you could be facing felony charges. Penalties include fines of up to $10,000 and a possible three-year prison sentence. This is in addition to the punishment you face for any additional charges that result from the crash.
