Gambling Crackdowns in San Jose

Gambling machines owners and illegal gaming operators are a frequent target of law enforcement officials, with undercover operations and coordinated busts in our area occurring on a regular basis. Bay area CBS affiliate KPIX 5 reported that on July 19, 2018, a takedown by police in San Jose netted more than 51 gambling machines, an estimated $75,000 in cash, and the names and addresses of additional people suspected to be involved in illegal gaming operations. A follow up raid based on warrants from the U.S.Department of Justice netted an additional 13 machines and close to $300,000 in suspected gambling proceeds. Additional raids are likely to occur by the end of the summer.

According to police officials, these types of raids have been ongoing for years, targeting illegal gaming and gambling operations that are housed within otherwise legitimate businesses. Dozens of business owners, managers, employees, and machine operators or suppliers end up being swept up as a result, along with the customers they serve. In addition to the threat of an illegal gaming conviction, many end up facing additional charges that are related to gambling activity, such as unlicensed alcohol sales, drug distribution, gang activity, weapons offenses, and racketeering.

Penalties for Illegal Gaming in San Jose

If you have been caught up in an illegal gaming sting or arrested as part of a police raid, you could be facing serious charges. Under the California Penal Code (Section 9-10-330 through 337), simply playing on an illegal gambling machine, participating in illegal gaming, or working where such activities are taking place could result in misdemeanor charges. In addition to a criminal record, a conviction could mean fines of up to $1,000 and up to six months in jail.

If you are charged with operating an establishment that hosts illegal gambling machines, you could also be facing a potential six month jail sentence for a first offense, and up to a year or more in prison if you have prior illegal gaming charges. You could also be fined up to $5,000 per machine, with additional amounts imposed for machines at multiple locations.
