Recovering Damages in California Personal Injury Cases Caused by Minors

When people are seriously injured in accidents in which minors were at fault, the injured victims may be concerned about their ability to recover damages that are enough to cover their losses. Teenagers often do not have sufficient resources to pay for the losses associated with personal injury matters. Because California recognizes this problem, the state provides a method for holding the minor's parents liable for the losses caused by their teen child's negligence.

California Law and Minors Who Cause Accidents

California has codified several statutory sections that specifically address situations in which minors cause accidents that injure others. Under California Vehicle Code § 17707, the person who signs the driver's license application for a minor holds imputed liability for any resulting injuries that might occur if the minor is involved in an accident. California requires that parents sign the driver's license applications for applicants who are under the age of 18.

CVC § 17708 continues to say that a parent may hold potential liability in any accident in which the parent has given his or her express or implied permission for the teen to drive a car owned by the parent. Neither of these sections involves any need to prove willful misconduct on the part of the minor who causes an accident.
