CA injury lawyerDuring the winter months in northern California, it is not uncommon for people to rely on alternative heat sources to keep the cold, wet weather at bay. Unfortunately, doing so can end up increasing your risks for home fires resulting in serious property damages and potentially life-threatening personal injuries. Wood stoves and fireplaces require regular maintenance to avoid becoming a hazard while portable heaters can be dangerous if used improperly and are too often subject to product defects. After a recent fire in San Jose left one family homeless, we encourage you to take the necessary precautions to keep yourself and your loved ones safe.

Mobile Home Fire Impacts Family in San Jose

Recently, a fire that broke out in a mobile home park in San Jose left a family of four displaced. Officials report that firefighters responded to a call for help from residents on Hermitage Drive shortly after midnight. When they arrived on the scene, they found the mobile home in flames. Fortunately, a smoke detector alerted the family of four to the fire in the early stages, allowing them to all evacuate safely. While there were no reported injuries, the structure itself sustained major damages and the family is currently staying with friends. Fire officials are continuing to investigate the blaze and have not determined a cause.

Foremost Insurance Group, an AARP approved mobile home insurance provider, states that these types of fires are common and that one of the most frequent causes is accidents involving home heating equipment. For people in the Bay area who often rely on alternative heat sources, such as fireplaces and wood stoves, regular cleaning and maintenance can help prevent sparks, flames, and dangerous fumes from impacting the home’s residents.

California accident lawyer, California injury attorneyIn August 2016, a plumber from Portsmouth, New Hampshire, was killed after being electrocuted by an electric oven and stove range. This prompted an investigation into the cause of the 52-year-old’s death, which led to the discovery that this make of Blomberg and Summit electric ranges were not properly grounded. These electric ranges can become energized, leading to shocks and electrocution. Now, the U.S. Consumer Product Safety Commission, Arçelik A.S. of Turkey, and Beko US are recalling 6,300 of these ranges, offering a free repair. The black or stainless steel freestanding, glass top, electric ranges affected have the model names:

  • Blomberg BERU 24200 SS;
  • Blomberg BERU 24100 SS; and
  • Summit CLRE24.

These ranges were sold by stores and Amazon.com across the U.S. between October 2012 and March 2017.

Your Rights When Hurt by a Defective Product

California injury lawyer, California defect product attorneySeven states and Washington, D.C. have legalized marijuana. An additional 28 states now have medical marijuana laws. With these changes, a new cause of injury has become known: defective marijuana. It may sound strange today, but experts believe that in the future consumers will be injured more frequently by marijuana sold at dispensaries. In order for consumers to be compensated for their injuries from marijuana, they must file a type of lawsuit called a product liability suit against the retailers, wholesalers, distributors and/or manufacturers of the drug. Product liability lawsuits seek to hold parties responsible for putting defective products into the marketplace for public use.

First Marijuana Product Liability Case Filed

The first lawsuit of this kind was filed in Colorado in 2015. A consumer alleged that the marijuana he purchased was laced with a harmful fungicide that he ingested. He claimed he would never have purchased marijuana that used such potentially dangerous ingredients. The consumer argued that marijuana companies are cutting corners in order to more easily grow plants and to create a more potent product.

California product liability attorney, California personal injury lawyerE-cigarettes may be gaining in popularity among smokers, but these new devices have left numerous people severely injured. Because these are hand-held devices and are devices used close to or touching the face, these exploding e-cigarettes pose serious danger.  If you have been injured by a defective e-cigarette, vape pen or any other malfunctioning device, you may be entitled to compensation under a legal theory of personal injury law called “product liability.”

Cause of Exploding E-Cigarettes

According to the U.S. Fire Administration, the battery is the part of the e-cigarette that causes the explosion. E-cigarettes use lithium ion batteries with flammable liquid electrolytes. This liquid is prone to overheating and exploding when the battery receives too much voltage when charging. This is just one of the reasons why e-cigarettes explode. E-cigarettes are a new technology, and the industry is not highly regulated. Many e-cigarettes are produced in China.
