Three-Year-Old Killed in Parking Lot Accident

Posted on in Catastrophic Injuries

CA accident lawyerWhen people hear of car accidents resulting in serious injuries, they tend to think of those that happen along highways, intersections, and other high traffic areas. The recent death of a toddler in San Jose calls attention to one often overlooked site where some of the most potentially deadly types of crashes can occur. Parking lot accidents are an unfortunately common type of collision. The following sheds light on the risks and how these types of crashes frequently happen.

Death of Child Calls Attention to Parking Lot Dangers

A tragedy unfolded in San Jose recently when a three-year-old boy was struck and killed in a local parking lot. The accident happened in East San Jose, at a business near the southwest corner of Santa Clara and 24th Street.

The mother of the boy had just parked her vehicle and was walking into the business while the child waited in the car. The boy apparently was able to get free of his car seat and opened the car door, jumping out of the parked vehicle. At the same time, a motorist in a 2012 Nissan truck was driving along the road. He was unable to stop in time and ended up striking the child.

The driver immediately took both the boy and his mother to a local hospital. Sadly, the child died as a result of his injuries. Officers with the San Jose Police Department questioned the driver and later released him. It was determined that neither drugs or alcohol played a role in the crash. The accident is the ninth motor vehicle collision in which a pedestrian suffered fatal injuries to occur in San Jose since the beginning of 2019.

Parking Lot Dangers

While the majority of car accidents do happen on major roads and highways, the National Highway Traffic Safety Administration (NHTSA) warns that parking lot crashes are an increasingly common concern. These crashes claim the lives of close to 1,500 people each year while leaving thousands of others suffering potentially serious injuries. Common ways in which parking lot accidents happen include:

  • Forward moving vehicles, such as when a car is moving through a parking lot or attempting to enter or exit
  • Backing accidents, such as when a vehicle attempts to back out of a parking space
  • Rollaway vehicles, such as when children are left inside and the brake is disengaged
  • Accidents involving disabled vehicles or those stopped in no-parking areas

The busier a store or business is, the more likely parking lot accidents are to occur. Particularly on weekends and holidays, serious accidents can happen when drivers are in a hurry, distracted, or stressed in looking for a space.
