Exploding E-Cigarettes Leave Victims Severely Injured

Posted on in Catastrophic Injuries

California product liability attorney, California personal injury lawyerE-cigarettes may be gaining in popularity among smokers, but these new devices have left numerous people severely injured. Because these are hand-held devices and are devices used close to or touching the face, these exploding e-cigarettes pose serious danger.  If you have been injured by a defective e-cigarette, vape pen or any other malfunctioning device, you may be entitled to compensation under a legal theory of personal injury law called “product liability.”

Cause of Exploding E-Cigarettes

According to the U.S. Fire Administration, the battery is the part of the e-cigarette that causes the explosion. E-cigarettes use lithium ion batteries with flammable liquid electrolytes. This liquid is prone to overheating and exploding when the battery receives too much voltage when charging. This is just one of the reasons why e-cigarettes explode. E-cigarettes are a new technology, and the industry is not highly regulated. Many e-cigarettes are produced in China.

Victims of Exploding E-Cigarettes

One California woman was awarded $1.9 million after an e-cigarette spewed hot metal on her dress setting it on fire. The e-cigarette was charging when the fire started. She sustained second-degree burns on her hands, legs and buttocks. She was left with permanent scars. She brought suit in a Riverside, California court, and a jury determined that the e-cigarette distributor, wholesaler and retailer were all responsible for her injuries.

Another California man alleges in a lawsuit that his e-cigarette malfunctioned while he was smoking out of it. He says that his mouth and dominant hand were both badly burned. One of the man’s fingers had to be amputated, and he required surgery on his tongue.

Other people who have been injured from e-cigarettes report that they have needed skin grafts and have received concussions from the blast. Property damage from the ensuing fire has also been reported.

Contact a San Jose Product Liability Lawyer

If you have been injured because of a malfunctioning e-cigarette or vape pen, it is critical that you receive legal counsel as soon as you are able. Product liability lawsuits are complex in that there are likely a number of parties liable for your injury.

As a consumer, you should be able to trust that a device sold to you is safe for your use. Holding manufacturers, retailers, and distributors accountable for these faulty products helps keep such products off the market.
